Commercial Litigation and Appeals

MARC attorneys have vast expertise handling commercial disputes in state and federal courts in New Jersey, New York and around the country. Because we emphasize that litigation is often not the best way to resolve a dispute, we also assist with alternative dispute mechanisms such as mediation and arbitration.

Our recent engagements include:

  • Winning a seven-figure summary judgment award on behalf of a distribution company in a federal lawsuit that alleged fraud and fraudulent transfer by corporate officers. We also pierced the corporate veil to impose individual liability on them.
  • Winning a no-cause decision in a federal lawsuit seeking damages and a contempt citation for Federal Trade Commission false-advertising claims.
  • Winning a mid-six-figure judgment, after an arbitration matter before FINRA, against an investment adviser on claims of fiduciary breach and securities-law violations.
  • Successfully prosecuting a wines/spirits importer’s claims in an international trade dispute with a European supplier.
  • Being retained in an international construction dispute over infrastructure in Africa.
  • Obtaining a lucrative settlement on behalf of a commercial client over an alarm company’s failure to respond to a robbery.
